Lemon Laws for Used Cars in California

Lemon Laws in California are laws which state that a manufacturer is responsible for his product and is liable for its repair or replacement if it proves defective within the warranty period. This even applies for second hand or used cars provided certain guidelines are followed at the time of purchase.

First and foremost, any warranty or any condition that the retailer mentions must be put on paper for it to be legally binding. Remember, never take the dealer’s word for it. In case you get cheated, it’ll take much more effort to substantiate your case at the time of the hearing. Secondly, get the car certified by a recognized mechanic as many people may trick you into buying a car which has the same problems for which it was returned back to the dealer. Another point that must be kept in mind is to use the vehicle only for private purposes and not commercially. And approach the court only if the problem arose during the warranty period.

California Lemon Laws can be applied to hired cars too but only is they are covered under warranty. Many warranty schemes provide higher distance covers and may suit your needs. Lemon Laws provide the individual to seek a replacement or sufficient repairs and can also be used to compensate for your attorney’s fees. And that’s not all. These laws apply to two – wheelers, boats, recreational vehicles and all other modes of transports, as long as they are for personal use.
